Lanai Group LLC dba Hot Sauce Headquarters respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA").
1. Designated agent
DMCA Agent, Lanai Group LLC dba Hot Sauce Headquarters, Attn: Mike Smith, 732 S 6th St, Ste R, Las Vegas, NV 89101 · stayspicy@hotsauceheadquarters.com
The fastest way to send a notice is the Report copyright infringement form on our website.
2. Takedown notice
A notice must be in writing and include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim is infringed.
- Identification of the material on Hot Sauce HQ you want removed, with enough detail for us to find it (for example, its web address).
- Your name, mailing address, phone number and email.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
We aim to review notices within 1 business day. When a notice is valid, we remove or disable access to the material and notify the member or brand who posted it.
3. Counter-notice
If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notice to our agent that includes:
- Your physical or electronic signature.
- Identification of the material removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district where Hot Sauce HQ may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We forward valid counter-notices to the person who sent the original notice. Unless that person tells us within 10 business days that they have filed a court action to restrain the activity, we restore the material within 10 to 14 business days after receiving the counter-notice.
4. Misrepresentations
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees.
5. Repeat infringers and fraud
- We close the accounts of members and brands who are repeat infringers in appropriate circumstances.
- No refund is given for any paid service when an account is closed for repeat infringement or fraud.
- Fraudulent notices, counter-notices or other fraudulent activity may result in legal action, including criminal reports to police and other authorities, disclosure of all relevant information to those authorities, and civil action.
6. Brand logos and photos
Logos and photos uploaded by a brand are licensed to Hot Sauce HQ permanently under the Brand Terms (Section 5), so they are not removed because a brand leaves Hot Sauce HQ. If you own the copyright in an image a brand uploaded without your permission, send a takedown notice as described in Section 2.
7. Other intellectual property
For trademark or other concerns that are not copyright, email stayspicy@hotsauceheadquarters.com with details. Using a brand's name to identify and review its products is not infringement.
